Newfoundland and Labrador Hydro
  Application:  
  Application by Newfoundland and Labrador Hydro for approval of a revision to the Revised Energy Supply Cost Variance Deferral Account, pursuant to Order No. P.U. 29(2020).
  Decision:  
 
  1. The proposed revision to the Revised Energy Supply Cost Variance Deferral Account as set out in Schedule A, with an effective date of January 1, 2021, is approved.
  2. Hydro shall pay all expenses of the Board arising from this Application.

Newfoundland and Labrador Hydro
  Application:  
  Application by Newfoundland and Labrador Hydro for approval for an Order, pursuant to sections 41 and 78 of the Act: (a) approving its 2021 capital purchases and construction projects in excess of $50,000; (b) approving its 2021 Capital Budget of $107,452,400; and (c) fixing and determining its average rate base for 2017, 2018, and 2019 in the amounts of $2,068,754,000, $2,265,683,000, and $2,306,047,000 respectively.
  Decision:  
 
  1. Hydro’s proposed construction and purchase of improvement or additions to its property in excess of $50,000 to be completed in 2021, as set out in Schedule A to this Order, are approved.
  2. Hydro’s proposed multi-year proposed construction and purchase of improvement or additions to its property in excess of $50,000, as set out in Schedule B to this Order, are approved.
  3. Hydro’s 2021 Capital Budget for improvements or additions to its property in an amount of $103,986,400, as set out in Schedule C to this order, is approved.
  4. Hydro’s average rate base for the year ending December 31, 2017 is hereby fixed and determined to be $2,068,754,000.
  5. Hydro’s average rate base for the year ending December 31, 2018 is hereby fixed and determined to be $2,265,683,000.
  6. Hydro’s average rate base for the year ending December 31, 2019 is hereby fixed and determined to be $2,306,047,000.
  7. Unless otherwise directed by the Board Hydro shall file, with the 2022 Capital Budget Application, an updated overview in relation to the proposed capital expenditures for the Holyrood Thermal Generating Station.
  8. Unless otherwise directed by the Board Hydro shall file an annual report to the Board on its 2021 capital expenditures by March 1, 2022.
  9. Unless otherwise directed by the Board Hydro shall provide, in conjunction with the 2022 Capital Budget Application, a status report on the 2021 capital budget expenditures showing for each project:
      1. the approved budget for 2021;
      2. the expenditures prior to 2021;
      3. the 2021 expenditures to the date of application;
      4. the remaining projected expenditures for 2021;
      5. the variance between the projected total expenditures and the approved budget; and
      6. an explanation of the variance.
  10. Hydro shall pay all costs and expenses of the Board incurred in connection with the Application.

Newfoundland and Labrador Hydro
  Application:  
  Application by Newfoundland and Labrador Hydro, acting in its capacity as the Newfoundland and Labrador System Operator, for approval of amendments to the pro-forma Transmission Service Agreements, the rates and rate methodology and the Transmission Policies and Procedures, pursuant to sections 71 and 75 of the Act.
  Decision:  
 
  1. The amendments to the pro-forma Transmission Service Agreements, the Methodology for the Development of Rates for Transmission Service, and the NL Transmission Policies and Procedures, as filed with the Application, are approved on an interim basis.
  2. The rates for transmission service, as set out in Schedule A to this Order, are approved on an interim basis, effective January 25, 2021.
  3. The rates for transmission service when the Labrador-Island Link comes on-line are approved, as filed, on an interim basis, and Hydro shall file an application at least seven days before these rates are to become effective, setting out the rates and the proposed effective date of these rates.
  4. Hydro shall pay the expenses of the Board incurred in connection with this matter.

Newfoundland and Labrador Hydro
  Application:  
  Application by Newfoundland and Labrador Hydro, of a revised Power Service Agreement, a Firm Energy Power Purchase Agreement, and a Second Amended and Restated Capacity Assistance Agreement between Hydro and Corner Brook Pulp and Paper Limited, pursuant to sections 70, 71 and 80 of the Act.
  Decision:  
 
  1. The Power Service Agreement as set out in Schedule A to this Order is approved.
  2. The Firm Energy Power Purchase Agreement as set out in Schedule B to this Order is approved.
  3. The Second Amended and Restated Capacity Assistance Agreement as set out in Schedule C to this Order is approved and the reporting requirements set out in Order No. P.U. 40(2018) are continued.
  4. Hydro shall pay all expenses of the Board arising from this Application.

  Application:  
  Application by Newfoundland and Labrador Hydro for approval to continue the current Island Industrial Customer rates pursuant to sections 70(1) and 71 of the Act.
  Decision:  
 
  1. The January 1, 2021 Rate Stabilization Plan adjustments for Island Industrial Customers is delayed until a further Order of the Board.
  2. The current Island Industrial Customer rates are continued until further order of the Board.
  3. Hydro shall pay all expenses of the Board arising from this Application.

Newfoundland and Labrador Hydro
  Application:  
  Application by Newfoundland and Labrador Hydro for approval pursuant to sections 70(1) and 76 of the Act, for the approval of the 2021 Island Industrial Customer Rate Stabilization Plan Adjustments in accordance with the Rate Stabilization Plan Rules.
  Decision:  
 
  1. The forecast of 1,174,603 barrels to be used in the calculation of the Island Industrial Customer Fuel Price Projection and Island Industrial Customer RSP Fuel Rider for 2021 is approved.
  2. The transfer of the remaining Island Industrial Customer 2017 GRA Cost Recovery Rider balance as of December 31, 2020 of $271,092 into the Island Industrial Customer RSP Current Plan and the conclusion of the Island Industrial Customer 2017 GRA Cost Recovery Rider effective January 31, 2021 is approved.
  3. The debit transfer of $2,476,684 to the Island Industrial Customer RSP Current Plan balance as of December 31, 2020 is approved.
  4. The Island Industrial Customer one-time bill credit in the amount of $2,476,684 to be allocated by customer based on 2020 energy ratios and reflected on Island Industrial Customer bills issued in March 2021 is approved.
  5. The Island Industrial Customer rates to be effective on all electrical consumption on and after February 1, 2021, as set out in Schedule A to this Order, are approved.
  6. Hydro shall pay all expenses of the Board arising from the Application.

  Application:  
  Approval of Newfoundland and Labrador Hydro's Network Additions Policy for the Labrador Interconnected system.
  Decision:  
 
  1. The Network Additions Policy for the Labrador Interconnected system, as set out in Schedule A to this Order is approved, effective April 1, 2021.
  2. Hydro shall file a report on or before July 1, 2021 with respect to the feasibility of the addition of a Non-Firm Rate option to the Network Additions Policy.
  3. Hydro shall file a report on or before July 1, 2023 setting out recommendations with respect to the transition to the “But For” approach as of January 1, 2024.
  4. Hydro shall pay all expenses of the Board arising from this Application.

  1. Hydro's proposal to deviate from IFRS, using IFRS 14 - Regulatory Deferral Accounts, to allow recognition of expenses related to the purchase of pre-commissioning energy in accordance with the terms of the Muskrat Falls Power Purchase Agreement is approved.

  Application by Newfoundland Power Inc. for an Order pursuant to sections 41 and 78 of the Act: (a) approving a 2021 Capital Budget of $111,298,000; (b) approving certain capital expenditures related to multi-year projects commencing in 2021; and (c) fixing and determining a 2019 rate base of $1,153,556,000; and Order No. P.U. 37(2020) in relation to Newfoundland Power Inc.'s 2021 Capital Budget Application; and Newfoundland Power's request for approval of proposed expenditures associated with a new substation for St. John's North-Portugal Cove.

  1. Newfoundland Power's proposed capital expenditures associated with the new St. John's North-Portugal Cove substation, in the amount of $6,794,000, are approved.

  Application by Newfoundland Power Inc. for an Order pursuant to sections 41 and 78 of the Act: (a) approving a 2021 Capital Budget of $111,298,000; (b) approving certain capital expenditures related to multi-year projects commencing in 2021; and (c) fixing and determining a 2019 rate base of $1,153,556,000; and Order No. P.U. 37(2020) in relation to Newfoundland Power Inc.'s 2021 Capital Budget Application; and Newfoundland Power's request for approval of proposed capital expenditures, in the amount of approximately $31.6 million, to replace its customer service system.
  Decision:  
 
  1. Newfoundland Power’s proposed capital expenditures to replace its customer service system, in the amount of $9,903,000 in 2021, $15,826,000 in 2022 and $5,917,000 in 2023, are approved.
  2. Newfoundland Power’s multi-year construction and purchase of improvements or additions to its property to begin in 2021 approved in Order No. P.U. 37(2020) are amended, as set out in Schedule A to this Order.
  3. Newfoundland Power’s 2021 Capital Budget for improvements or additions to its property approved in Order Nos. P.U. 37(2020) and P.U. 10(2021) is amended, as set out in Schedule B to this Order.
  4. Newfoundland Power shall pay all expenses of the Board arising from this application.
