IN THE MATTER OF THE MOTOR CARRIER ACT,

CHAPTER M-19, R.S.N. 1990,

 

                  AND

 

IN THE MATTER OF THE APPLICATION OF

Gilbert Easton, o/a G & P Enterprises                   

FOR THE APPROVAL OF THE ISSUANCE OF A

MOTOR CARRIER CERTIFICATE.

 

 

 

 

WHEREAS by application dated January 12, 2001, completed in accordance with the said Act and Regulations, Gilbert Easton, o/a G & P Enterprises, applied to the Board of Commissioners of Public Utilities for approval of the issuance of a Motor Carrier Certificate to operate the services described in the Schedules attached hereto, and

 

WHEREAS a notice of the application was published in the February 9, 2001  edition of The Newfoundland Gazette, and


WHEREAS on February 27, 2001 the Board received an objection to the granting of a Motor Carrier Certificate to Gilbert Easton, o/a G & P Enterprises,  from DRL Coachlines Limited, St. John’s, Newfoundland, and

 

WHEREAS  the objector set out by way of letter the reasons why the application should not be granted, and

 

WHEREAS at a meeting of the Board, held on March 28, 2001, it was determined that Gilbert Easton, o/a G & P Enterprises, had complied with the requirements of the Act and Regulations, and

 

WHEREAS, pursuant to Section 9.(1) of the Act, upon reviewing the information supplied by the objector as well as additional information provided to the Board by the Director, Regulatory and Advisory Services, the Board determined that a presumptive case had not been made against the granting of the certificate to Gilbert Easton, o/a G & P Enterprises.              

 

IT IS THEREFORE  ORDERED THAT:

 

The application of  Gilbert Easton, o/a G & P Enterprises, be and it is hereby approved and a Motor Carrier Certificate granted.
